Mike Davis, a former law clerk to Justice Neil Gorsuch, insists that Senate Republicans must stand strong against these appointments and use every available tactic to delay or block them.
Despite their recent electoral victories, Senate Republicans must not fall into the trap of complacency. Davis emphasizes that with Democrats holding a majority in the Senate until January, the Republicans must remain active and assertive in opposing Biden’s judicial nominees. These nominees are seen as part of a broader left-wing agenda to reshape the judiciary, making it more aligned with progressive ideals, which many conservatives view as harmful.
One of the most concerning nominees is Tali Farhadian Weinstein, nominated to a district court seat in New York. She has expressed support for controversial policies, such as allowing noncitizens to vote. If confirmed, these judges could issue rulings that undermine conservative policies, making it essential for Republicans to do everything in their power to stop their confirmations.
Davis calls on Senate Republicans to use all available time for debate, as the Senate rules allow up to 30 hours of discussion for circuit court nominees. By forcing these debates, Republicans can delay the confirmation process and buy time until the new Congress takes control. Even if it seems like a symbolic gesture, forcing Democrats to use up debate time would send a strong message that Republicans are serious about stopping the confirmation of leftist judges.
The importance of these confirmations cannot be overstated. With over 160 judges already appointed by Biden, the ideological makeup of the federal judiciary is shifting in a way that could have lasting implications for American law. Senate Republicans must not allow these appointments to pass quietly. They must stand firm and fight against Biden’s judicial picks, not for the sake of obstruction, but to protect the integrity of the judiciary.
